Application for Customs Filing and Protection of Intellectual Property Rights
Intellectual property customs filing is a prerequisite for customs to take proactive protective measures. Although intellectual property rights holders can directly apply to the customs at the place where the suspected infringing goods enter or exit for detention without the need for prior intellectual property registration, it is usually difficult for intellectual property rights holders to discover infringing goods that are about to be imported or exported solely through their own efforts. The daily supervision of imported and exported goods by customs is currently the main way to discover infringing goods. Only when the intellectual property rights have been registered with the General Administration of Customs can the customs notify the intellectual property rights holder of the active discovery of suspected imported and exported infringing goods, and have the right to investigate and handle the suspected infringing goods.
If the customs discovers any suspected infringement of intellectual property rights registered with the General Administration of Customs during the supervision of import and export goods, they shall immediately notify the intellectual property rights holder in writing. The intellectual property rights holder shall, within 3 working days from the date of written notice from the customs, apply to the customs for the detention of suspected infringing goods.
